LA MINORÍA DE EDAD PENAL A LO LARGO DE LA HISTORIA ESPAÑOLA

Abstract

Este Trabajo de fin de grado trata sobre la responsabilidad penal de los y las menores de edad en el derecho histórico español. El objetivo es analizar la evolución de esta tipología de circunstancias modificativas de responsabilidad penal a lo largo de la legislación española, de cómo el legislador histórico ha tratado normativamente desde el primer momento que encontramos por casualidad a esta institución, hasta el día presente. Comenzamos nuestro análisis en el Derecho romano, estudiando esta institución de la menor edad penal hasta la codificación contemporánea. La evolución histórico jurídica ha sido de enorme interés, tratándose además de un aspecto general de la historia legislativa de la menor edad. La institucionalización de una edad determinada para hacer a una persona responsable de la comisión de un delito ha constituido, y sigue constituyendo hoy día, un problema aún hoy difícil de solucionar, como lo prueba el hecho de la importante legislación histórica que ha tratado esta cuestión.

This project is a report on the responsibility of the people who is under age; here I will try to express the evolution of this person in the Spanish laws of how has it been legislated since the first moment that we come across to this institution, to the present day. We start in the Roman law and finish in nowadays. The long road of this evolution is the story of our laws about the children. The fact of saying an age from which a person becomes responsible for committing a criminal act has constituted, and it still goes on doing, a problem difficult to solve. As proof of this fact, we can have a look to the huge amount of legislation has been dedicated to resolve it.
