AGRESIONES SEXUALES A MENORES

Abstract

El Título VIII del Código Penal castiga todo acto de carácter sexual practicado con menores de dieciséis años, debido a su falta de autodeterminación sexual. El presente trabajo realiza un breve recorrido sobre los orígenes del maltrato infantil y aborda cuestiones relevantes acerca de los delitos contra la libertad e indemnidad sexual del menor como son la edad de consentimiento sexual y el bien jurídico protegido. Se torna central la figura de la agresión sexual, tanto sus características como los elementos fundamentales que permiten establecer la diferencia con el abuso sexual. También se analizan los tipos delictivos contenidos en el artículo 183 del Código Penal. Por último, se examinan las modificaciones que experimentan los delitos sexuales tras la entrada en vigor de la Ley Orgánica 5/2010, de 22 de Junio y la Ley Orgánica 1/2015, de 30 de Marzo, respectivamente.

Title VIII of the Criminal Code punishes any act of a sexual nature committed against minors under the age of sixteen, because of their lack of sexual self-determination. This paper gives a brief overview of the origins of child abuse and addresses relevant issues about crimes against the sexual freedom and sexual inviolability of the child, such as the age of sexual consent and the legally protected right. The figure of sexual assault, both its characteristics and the fundamental elements that make it possible to distinguish it from sexual abuse, becomes central. The types of crime contained in article 183 of the Criminal Code are also analysed. Finally, it examines the modifications experienced by sexual offences after the entry into force of Organic Law 5/2010 of 22 June and Organic Law 1/2015 of 30 March, respectively.
