Apología como delito especial en el terrorismo

Abstract

[ES] Este trabajo trata del análisis de la aplicación de la apología como delito especial en el ámbito del terrorismo, recogida por el artículo 578 del CP. Será necesario repasar el panorama histórico normativo y observar la evolución de la apología, así como de los delitos de terrorismo en nuestro sistema penal. Para profundizar en la apología del terrorismo, hemos de delimitar su alcance como acto preparatorio, recogido en el artículo 18.1 CP, para establecer el ámbito típico del tipo autónomo del artículo 578 CP. Es procedente estudiar la tipificación de figuras que no resultan objetivamente peligrosas para el bien jurídico tutelado, como la difusión de mensajes con contenido incitador de los apartados 1 y 2 del artículo 579 CP. Consecuencia de ello será la restricción del derecho fundamental a la libertad de expresión, por lo que hemos comprobar si queda justificada dicha restricción a través del castigo de conductas apologéticas.

[EN] In this proyect, it will be analyzed the enforcement of apology as a special crime in the field of terrorism, in the article 578 of the Criminal Code. It is pertinent to review the normative perspective and to observe the evolution of the apology, as well as the crimes of terrorism in our penal system. To deepen the apology, we must define its scope as a preparatory act, in the article 578 of the Criminal Code, to establish the typical scope of the crime of article 578. It will be study the penalty of figures that are not objectively dangerous, as the diffusion of messages with inciting content, of the paragraphs 1 and 2 of the article 579. The consequence of this will be the restriction on freedom of expression, so it is important to check if this limitation is justified by the punishment of the apology.
