Resumen
En este Trabajo de Fin de Grado vamos a estudiar el Delito de
Cohecho, en su modalidad de cohecho activo, el cual encontramos
regulado en el Código Penal, en su Título XIX, llamado Delitos
contra la Administración Pública. Como he mencionado, nos
basaremos en explicar la modalidad activa ya que el cohecho en sí
es muy amplio y no se podría explicar de manera detallada en tan
breve espacio, aun así, se podrán observar reseñas para explicar
los más transcendentes contrastes entre ambas.
También trataremos las diferentes opiniones que se dan por
diversos autores especialistas en el tema, los cuales difieren en su
visualización del tipo, dando cada cual su explicación por la que
piensan así, además veremos también cómo ha ido variando el
delito de cohecho según se ha ido reformando el Código Penal.
In this Final Degree Thesis, we are going to study the Bribery Crime, in its modality of active bribery, which is regulated in the Criminal Code in its title XIX by the name of Crimes against the Public Administration. As I have mentioned, we will be based on explaining the active modality since the bribery itself is very broad and could not be explained in detail in such a short piece of research, even so, you will be able to observe reviews to explain the most transcendent contrasts between both. We will also discuss the different opinions given by various authors specialized in the subject, which differ in their visualization of the type, giving each one of them their explanation why they think so. In addition, we will also see how the crime of bribery has been varying over the year as the Criminal Code has
