ESTUDIO JURÍDICO DE ASESINATO Y AGRESIÓN SEXUAL CON VÍCTIMA MENOR DE DIECISÉIS AÑOS

Abstract

[ES] Este dictamen pretende resolver unas cuestiones jurídicas planteadas por el padre de la víctima. Atendiendo a los antecedentes de hecho, sobre la base de la documentación proporcionada, así como del derecho positivo, doctrina y jurisprudencia aplicables al caso, podemos afirmar que los hechos constituyen un delito de asesinato previsto en los artículos 139 y 140 del Código Penal castigado con prisión permanente revisable, en concurso real de delitos con otro de agresión sexual tipificado en el artículo 183 del Código Penal sobre menor de dieciséis años. Son coautores Juan Lobo y José Campos. Instruido ante el Juzgado de Instrucción y enjuiciado ante el Tribunal del Jurado en la Audiencia Provincial. No concurren circunstancias modificativas de la responsabilidad criminal. Será impuesta condena penal principal, accesorias, costas y pago de responsabilidad civil.

[EN] This opinion tries to solve a few juridical questions raised by the father of the victim. Attending to the precedents of fact, on the base of the proportionate documentation, as well as of the statute law, doctrine and applicable jurisprudence to the case, we can affirm that the facts constitute a crime of murder foreseen in the articles 139 and 140 of the Penal Code punished with permanent revisable prison, in royal contest of crimes with other one of sexual aggression typified in the article 183 of the Penal Code about sixteen-year-old minor. They are co-authors Juan Lobo and Jose Campos. Instructed before the Examining magistrate's court and judged before the Court of the Juror in the Provincial Hearing. There do not meet modificative circumstances of the criminal responsibility. There will be imposed principal criminal conviction, outbuildings, coasts and payment of civil responsibility.
