Aspecto fundamentales de la mediación familiar en la Ley Andaluza de Mediación Familiar

Abstract

[ES]En este trabajo voy a poner todo mi esfuerzo en tratar de explicar la mediación familiar, cómofunciona y la importancia de la misma. Vivimos en un mundo donde la litigación está a la orden del día y sería muy beneficioso para las comunidades de individuos que pudieran resolver sus problemas sin enzarzarse en batallas legales.

Ello vendría dado desde que entendemos que la mediación familiar encaja en este mundo complejo donde debemos evitar los conflictos y encontrar soluciones que implique la posición de "ganador" y "perdedor". En la mediación familiar ambas partes perderán un poco, para ganar en conjunto al final del proceso.

El mediador aparece como un canalizador de los intereses de ambos para llegar a un acuerdo que haga que las partes se sientan identificadas con la decisión que tomaron y no entren nuevamente en conflicto. Si los individuos fueran más abiertos hacia la mediación familiar, se desestresaria los juzgados y nuestra comunidad vería que hay más formas de resolver los conflictos que pleiteando en el juzgado.

[EN]In this essay 1 will put ali my efforts towards trying to explain family mediation, how it works and the importance of it.We live in a world where litigation is a must in our days and it's very beneficia! to the communities of people that they can resolve their issues without engaging in legal proceedings.

Since we understand that family mediation fits in a complex world where we avoid the encounters and try to find solutions that doesn't mean a loser and a winner. In family mediation, both parts will lose a bit at the very beginning, to win as a whole at the end of the process.

The mediator appears as a way to channel both interests towards a deal which will make both happy about the decision they took, and will avoid confrontation . lf everybody would be more open to mediation, we could reduce by a lot the stress of the courts and our community will see that there' s other way to resolve our conflicts than fighting in the court.
