Crisis económica y tutela de los derechos sociales

Abstract

[ES] Los derechos sociales son derechos que han ido evolucionando con el paso del tiempo, en la actualidad podemos encontrarlo reconocidos tanto en nuestra Constitución como en determinados Estatutos de Autonomía debido a las reformas que han sido desarrolladas en estos. La inclusión de derechos sociales en los Estatutos ha ocasionado un gran debate jurídico-constitucional en los últimos años. Analizaremos el concepto de este derecho así como su protección y su regulación, declaraciones etc.; Haremos referencia a como están desarrollados estos derechos en los Estatutos haciendo una especial mención en el Estatuto andaluz. Analizaremos como afecta la crisis actual a estos derechos analizando concretamente el derecho social a la vivienda.[EN] Social rights are rights that have evolved over time, now we find recognized both in our Constitution and certain statutes of autonomy due to the reforms that have been developed in these. The inclusion of social rights in the Constitution has caused a great legal and constitutional debate in recent years. We discuss the concept of this law as well as their protection and regulation, statements etc .; We will refer to these rights as they are developed in the Statutes with special mention in the Andalusian Statute. We analyze how the current crisis affecting these rights specifically analyzing the social right to housing.
