EL CONTRATO DE AGENCIA INTERNACIONAL

Abstract

El contrato de agencia internacional es el documento por el cual una de las partes, el agente, se obliga frente a la otra parte denominada principal o mandante, a realizar actos u operaciones por cuenta ajena en un determinado territorio y por un plazo concreto. Con respecto a la extinción del contrato surgen diferentes problemas por ello es necesario saber qué tribunales son los competentes para la resolución de los litigios y determinar qué ley es la que debe regir el contrato teniendo en cuenta los límites de la ley aplicable y las normas de protección del agente. Aplicar una ley u otra ya sea estatal o extranjera es muy importante para el contrato ya que ahí es donde se van a fijar todas las condiciones del contrato.

The agency agreement is the document by which, one of the parties, the agent, undertakes visàvis the order party, the principal, to perform acts or transactions for the account of others in a given territory and for a given period of time. Different problems arise with regard to the extintion of the contract and, it is therefore necessary, to know wich courts have jurisdiction to resolve disputes and to determine wich law should rule the contract, talking into account the limits of applicable law and the rules protecting the agent. Applying one law or another, whether state or foreign, is very important fro the agreement, since that is where all the conditions of it will be set.
