LA RESPONSABILIDAD PATRIMONIAL DE LA ADMINISTRACIÓN. EXCLUSIÓN POR FUERZA MAYOR.

Abstract

[ES] El trabajo que he desarrollado, tiene por objeto el estudio de la responsabilidad Patrimonial de la Administración Pública y la fuerza mayor como causa de exclusión de aquella. En un primer lugar, realizaremos una introducción sobre el origen de la responsabilidad patrimonial en nuestro país, observando cómo se produce una evolución legislativa hasta llegar a la regulación actual. Posteriormente, se hace mención a quién es el titular del derecho de responsabilidad, los tipos de responsabilidad patrimonial existente y los presupuestos o requisitos de esta responsabilidad, centrándonos, como he adelantado en la eximente de fuerza mayor. En primer lugar se explicara la definición de la misma, los casos en los que puede apreciarse, así como la opinión de la doctrina, jurisprudencia, dictámenes; analizando casos concretos donde se aprecia o no la fuerza mayor. Finalmente, haré una breve mención al procedimiento que hay que seguir para poder exigir la responsabilidad patrimonial y expondré una conclusión personal basada en todo lo analizado a lo largo del trabajo.

[EN] The work that I have developed, takes as a title " The Patrimonial Responsibility of the Public Administration" of general form, centring principally on the exclusion of responsibility because of major force. Therefore, in a generic way along the work the patrimonial responsibility develops, giving him more emphasis to the question of major force since it is on what we centre. In the first place, we will divide with an introduction on the patrimonial responsibility in our country and the origin of the same one, observing how a legislative evolution takes is produced up to coming to the current regulation. Later, there is mentioned the one who is the holder of the right of responsibility, the types of patrimonial existing responsibility and the budgets or requirements of this responsibility, centring since. I have improved previously in the exempting one of major force, first one was explaining the concept of the same one, the cases in which it can be estimated, as well as the opinion of the doctrine, jurisprudence opinions, analyzing concrete cases where it is estimated or the major force. Finally, brief mention to the procedure that it is necessary to realize to be able to demand the patrimonial responsibility and a personal conclusion based on everything analyzed along the work.
