LGTBIFOBIA DE ESTADO: ¿SUPONE EL REFUGIO UNA SOLUCIÓN EFECTIVA O PALIATIVA?

Abstract

La presente aproximación descriptiva, abordará la realidad de las personas solicitantes de asilo y refugiadas en el ámbito internacional. Con ella tratará de visibilizarse tanto las especificidades como las características compartidas entre las diversas identidades LGBTI en la situación de refugio, diferenciando para ello dos momentos: el primero en los países de origen o residencia, y el segundo en los países de asilo. Para esto, se analizarán los factores que motivan la migración forzosa junto a la situación actual de las personas en razón a su orientación sexual e identidad de género, puesto que, de detectar una problemática estructural o universal, se defenderá una respuesta con la misma naturaleza. En este caso se considerará causa universal de toda discriminación hacia lesbianas, gais, bisexuales, trans e intersexuales a la LGTBIfobia de Estado, cuestionándose por ello, la efectividad del refugio como solución para el ejercicio de los derechos humanos de estas personas.

The following descriptive approach, will tackle the reality that asylum seekers and refugees live over the international setting. It aim is to visibilize the singularities in addition to the shared characteristics of LGBTI identities in the asylum setting, distinguishing two different moments on this matter: firstly, the countries of origin and secondly, the host countries. In pursuit of this aim, the causes of the forced migration will be analysed, as well as the current situation of people according to their sexual orientation together with their gender identity, since in case of discovering a structural or universal issue, it might be responded with an answer made due to its nature. In this instance, the ‘LGTBIphobia of state’ will be considered the universal cause of discriminations made to lesbians, gays, bisexuals, trans and intersex people, questioning the efficacy of seeking asylum as a solution for this people to exercise their human rights.
