Resumen
El objetivo del presente trabajo es el análisis de los diferentes
estados excepcionales recogidos en el artículo 116 de la
Constitución y de la Ley Orgánica 4/1981 de los estados de
alarma, excepción y sitio.
También se recogen y analizan los dos estados excepcionales
aplicados hasta el momento en España junto con las medidas
adoptadas para hacer frente a esas situaciones. En concreto se
analizan si las medidas establecidas antes y después de decretarse
el ultimo estado de alarma como consecuencia de la situación
excepcional ocasionada por la pandemia del COVID-19 vulneran
o no los derechos fundamentales.
Para finalizar se compara brevemente las diferentes actuaciones
que han llevado a cabo otros países para hacer frente a la misma
situación excepcional.
The objective of this work is the analysis of the different exceptional states included in article 116 of the Constitution and Organic Law 4/1981 of the states of alarm, exception and siege. The two exceptional states applied so far in Spain are also collected and analyzed together with the measures adopted to deal with these situations. Specifically, they analyze whether the measures established before and after the last state of alarm was decreed as a consequence of the exceptional situation caused by the COVID-19 pandemic violate fundamental rights or not. Finally, a brief comparison is made of the different actions that other countries have carried out to face the same exceptional situation.
