IGUALDAD Y NO DISCRIMINACIÓN. DERECHOS DE LAS MUJERES VICTIMAS DE VIOLENCIA DE GÉNERO

Abstract

[ES] La aplicación de la Ley Orgánica 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género (B.O.E. núm. 313, de 29 de diciembre de 2004) ha traído consigo la consecución de una serie de objetivos en materia de Violencia de Género que nos llevasen a la erradicación de dicha violencia. Este fin quiere conseguirse con la implantación de una serie de derechos, leyes, etc. Para poner fin, el Estado impone la ley antes mencionada y, a su vez, da la potestad a las Comunidades Autónomas de llevar a cabo una Legislación Autonómica adaptada a las necesidades que cada Comunidad presente. Asimismo, estudiaremos la posible falta de igualdad entre la considerada como Violencia de Género y la considerada como Violencia Doméstica. Haremos mención al Consejo General del Poder Judicial, estudiando sus funciones.

[EN] The application of the Organic law 1/2004 of 28th December on Integrated Protection Measures against Gender-based vilence (B.O.E. nº 313, the 29th December of 2004) has brought the achievement of a series of objectives leading us to the eradication of this violence. The aim is the implementation of a series of rights, laws etc. To put end to this, the state impose the law mentioned before, and gives the authority to the Autonomous Communities to conduct the Autonõmica legislation adapted to the current needs. Additionally, we will examine the passive look of equality between the considered Gender-based violence and the considered Domestic violence. I will mention to the General Council of the Judiciary , studying its functions.
