La Kafala marroquí y su relación con el Derecho español

Abstract

[ES] La kafala es una medida de protección del menor de origen islámico. Se trata de una figura desconocida relativamente en nuestro ordenamiento, puesto que por las diferencias con el Derecho occidental y el carácter multifuncional de la kafala, no se puede equiparar completamente a ninguna figura de nuestro Derecho. El objeto del trabajo es conocer la figura, su caracterización y función, así como la problemática que presenta y las soluciones aportadas por el Derecho comparado y por el nuestro para poder reconocer sus efectos.

[EN] The kafala is a measure for the protection of minors of Islamic origin. It is a relatively unknown figure in our legal system, since due to the differences with western law and the multifunctional character of the kafala , it cannot be completely compared to any other figure in our law. The purpose of the work is to know the figure, its characterisation and function, as well as the problems it presents and the solutions provided by comparative law and by ours in order to be able to recognise its effects.
