GUARDA Y CUSTODIA COMPARTIDA: EVOLUCIÓN PROCESAL Y JURISPRUDENCIAL

Abstract

[ES] Este trabajo de fin de máster trata sobre el sistema de guarda y custodia compartida aplicable tras la crisis matrimonial o de pareja. Un sistema que ha evolucionado en nuestro ordenamiento jurídico asumiendo un papel muy importante en la actualidad, siendo los padres en primer lugar los que deben decidir si llevarla a cabo y de no existir acuerdo, siendo el Juez el que decida si se aplica al caso o no, siempre atendiendo al interés del menor que es el principal interesado de esta situación. A lo largo de este trabajo se analizará la evolución doctrinal y jurisprudencial de este régimen de guarda y un supuesto práctico que muestra la viabilidad de este sistema en la actualidad.

[EN] This work of end of master's degree treats on the system of saves and custody shared applicable after the marriage crisis or partner. A system that has evolved in our legal system assuming an important role nowadays, being the parents who must decide whether to apply this system and if there is no agreement, being the judge to decide if it applies to the case or not, always taking into account the interest of the minor who is the main interested in this situation. Throughout this work, we will analyze the doctrinal and jurisprudential evolution of this regime of guard and a so-called practical showing the viability of this system currently.
