LOS CONFLICTOS DE LA VIOLENCIA DE GÉNERO EN LOS JUZGADOS. IMPUNIDAD Y ESTEREOTIPOS

Abstract

[ES]Históricamente, el ámbito del poder ha sido ocupado por los hombres, relegando a las mujeres a un segundo plano en los espacios públicos y privados. La insuficiente atención especializada, las políticas sociales poco eficaces y las ayudas económicas débiles en la mayoría de los casos, conlleva la falta de respuestas idóneas a la salida de la violencia. Partiendo de la importancia de una formación y especialización del sistema judicial desde un enfoque de género y derechos humanos, englobando tanto las esferas normativas como judiciales o procesales en materia de violencia de género, siendo un elemento fundamental para modificar las prácticas que naturalizan y perpetúan la victimización secundaria e institucional a las que son sometidas las mujeres. Por tanto, se deben reivindicar y visibilizar todas las injusticias que los mecanismos institucionales provocan hacia las mujeres y que, desde el primer momento, se les ofrezca información ajustada a sus características y necesidades personales.

[EN]Historically, the sphere of power has been occupied by men, relegating women to a secondary position in both public and private spaces. Insufficient specialized attention, ineffective social policies and weak economic support in most cases, mean that there is a lack of suitable responses in the search for a way out of the situation of violence. Starting from the importance of training and specialization of the judicial system from a gender and human rights perspective, encompassing both the normative and the judicial or procedural spheres in matters of gender violence, it is an indispensable piece in modifying the practices which naturalize and perpetuate the secondary and institutional victimization of women. Therefore, all the injustices that institutional mechanisms provoke towards people must be vindicated and, from the first moment, they must be offered information, and adjusted to their personal characteristics and needs.
