Resumen
Esta revisión bibliográfica se ha realizado para la búsqueda de información exhaustiva y el estudio de la problemática de la trata de seres humanos con fines de explotación. El inicio de esta revisión va a consistir en la aclaración de conceptos, ya que pueden existir varias confusiones entre trata, explotación y tráfico. Con esto se pretende desmitificar y concienciar a la sociedad de las consecuencias que sufren las víctimas de este delito.
Hay que tener en cuenta un enfoque victimológico desde la disciplina del Trabajo Social para tratar esta problemática. Las víctimas de trata con fines de explotación laboral fueron captadas de forma engañosa con ofertas de trabajo falsas y al llegar al destino se percataron que las condiciones no eran las prometidas. Muchos de estos trabajadores y trabajadoras presentan una situación irregular de estancia en el país, lo que supone que presenten miedo para denunciar su situación. Asimismo, pueden tener una deuda con el empleador o tratante, lo que supone que su márgen de maniobra sea aún menor ya que están supeditados a lo que establezca dicha persona. A todo esto se le suma la escasez de taxatividad en el ordenamiento jurídico que da lugar a una desprotección de las víctimas por parte de los poderes públicos. Por lo tanto, se aboga desde el Trabajo Social en la creación de una concienciación y visibilización de la problemática e intervención en pos de poder ofrecer a las víctimas un procedimiento de protección y asistencia.
Desde el Trabajo Social se pretende aportar una labor profesional que permita eliminar los obstáculos provocados por la falta de taxatividadad de este delito; en pos de aplicar acciones y estrategias de identificación asistencia y protección de las víctimas en el marco jurisdiccional del Estado.
This literature review has been made to the search for comprehensive information and the study of the problem of trafficking in human beings for exploitation. The start of this review will consist in the clarification of concepts, since there may be multiple confusions between trafficking, exploitation and trafficking. This aims to demystify and raise awareness in society of the consequences suffered by the victims of this crime. It should take into account an victimologic approach from the discipline of Social work to treat this problem. The victims of trafficking for labour exploitation were captured in a misleading way with false job offers and arriving at the destination we realized that the conditions were not the promised. Many of these workers have an irregular situation of stay in the country, which is to present afraid to denounce their situation. They may also have a debt to the employer or treating, which means that its room for manoeuvre is even less since they are subject to what the person set. In addition to all this the scarcity of MFIs in the legal system that gives rise to a checkout of the victims by public authorities. Therefore, calls from the Social work in the creation of awareness and visibility of the problem and intervention in order to provide a procedure for protection and assistance to victims. From the Social work is intended to provide a professional job that allows you to remove the obstacles caused by the lack of taxatividadad of this crime; in order to apply actions and strategies of identification, assistance and protection of victims in the judicial framework of the State
