El matrimonio islámico y su eficacia civil en España

Abstract

Como consecuencia de la creciente llegada a nuestro país de inmigrantes y la consiguiente convergencia cultural, se produce la ineludible necesidad de adecuación de nuestro ordenamiento jurídico ante esta nueva realidad. Llegados a este punto, y teniendo en cuenta cómo afecta dicha situación al Derecho de Familia, la firma de Acuerdos entre el Estado y las minorías religiosas toma vital importancia para abordar este asunto. Teniendo en cuenta esta problemática, he basado mi trabajo en el análisis del matrimonio islámico según Derecho Islámico, la celebración de estas uniones matrimoniales en España, el reconocimiento de su eficacia civil y los posibles conflictos resultantes de dichos enlaces en nuestro país, tema que me suscita gran interés.

As a consequence of the growing arrival of immigrants to our country and the consequent cultural convergence, there is an unavoidable need to adapt our legal system to this new reality. At this point, and taking into account how this situation affects Family Law, the signing of Agreements between the State and religious minorities takes on vital importance in addressing this issue. Bearing this problem in mind, I have based my work on the analysis of Islamic marriage according to Islamic Law, the celebration of these marital unions in Spain, the recognition of their civil efficacy and the possible conflicts resulting from such unions in our country, a matter that arouses great interest in me.
