Resumen
[ES] El presente trabajo va dirigido, en forma de dictamen, a la resolución de las
controversias más llamativas que pueden darse en un proceso de divorcio en el cual,
además de discutirse la custodia de los hijos menores de edad en base a la voluntad de los
propios menores y su bienestar, se da de forma intercalada en el proceso civil un proceso
penal por presunto maltrato familiar en el ámbito de la violencia de género con su
consecuente orden de protección, del cual derivará un proceso de divorcio paralelo, con
las pertinentes actuaciones procesales, y un debate sobre la presunción de inocencia
atacada por la declaración del denunciante, para finalmente desembocar en un divorcio
civil doble.
[EN] The present work is directed, in the form of an opinion, to the resolution of the most striking controversies that can occur in a divorce process in which, in addition to discussing the custody of minor children based on the will of their own minors and their wellbeing, is given interspersed in the civil process a criminal proceeding for alleged family abuse in the area of gender violence with its consequent order of protection, which will lead to a parallel divorce process, with relevant procedural actions , and a debate on the presumption of innocence attacked by the whistleblower's declaration, in order to finally lead to a double civil divorce.
