SUSTITUCIÓN FIDEICOMISARIA A FAVOR DEL DESCENDIENTE INCAPACITADO

Abstract

[ES] Este trabajo indaga en un tipo de sustitución hereditaria como es la sustitución fideicomisaria. He analizado los sujetos que integran esta figura, las clases de sustitución fideicomisaria que existen, los límites que presenta y la extinción de la misma. De un modo más específico, el trabajo se centra en la figura excepcional de la sustitución fideicomisaria a favor de un hijo o descendiente incapacitado, que se regula en el artículo 808.3 del Código Civil y supone una excepción a la regla general de intangibilidad de la legítima.

[EN] This essay is based on a kind of hereditary substitution such as the trust is. I have analysed the subjects that be part of this legal form, the kinds of trust that exist, the limits that it presents and the extinction of it. More specifically, the essay is focuses in the exceptional figure of the trust in favour of an incapacitated son or descendant, that is regulated on the article 808.3 of the Civil Code and it supposes an exception to the general rule of the intangibility of the legitimate.
