Figuras delictivas del acoso en el Código Penal

Abstract

[ES] En el presente trabajo se va a realizar un estudio de las diversas modalidades de acoso reguladas en el Código Penal español: el acoso laboral, acoso inmobiliario, acoso sexual, ciberacoso, acoso de acecho o predatorio y el acoso escolar. Podríamos definir genéricamente, el concepto de acoso como una violencia psicológica de manera reiterada consistente en un trato indigno hacia otro que atente contra la integridad moral y la libertad de la persona. Con lo cual, este fenómeno se encuentra muy presente en la actualidad y, como consecuencia, vamos a realizar un análisis de cada modalidad de acoso indagando sobre la regulación de cada uno de ellos en el Código Penal y examinaremos cuáles son las mayores problemáticas que pueden ocasionar su correspondiente regulación y cómo se podrían solucionar.

[EN] In the present work we are going to realize a study of the different forms of harassment gathered in the Spanish Penal Code: mobbing, real-estate mobbing, sexual harassment, child-grooming, stalking and bullying. We could define generically, the concept of harassment as a psychological violence of repeated way consisting of an unworthy treatment towards another that threatens the moral integrity and the freedom of the person. With this, this phenomenon is very present actually and, as a consequence, we are going to carry out an analysis of each harassment modality inquiring about the regulation of each one of them in the Penal Code and we will examine which are the biggest problems that can be cause its corresponding regulation and how they could be solved.
