Resumen
[ES] El presente trabajo se plasma a través de la realización de un Dictamen jurídico de Orden Jurisdiccional Social, y dentro de esta, la realización de un Caso Práctico en materia de Despidos. En el marco de las relaciones laborales existen numerosas decisiones empresariales, con vulneraciones de los derechos fundamentales, que la Constitución Española reconoce al trabajador. De esta necesidad protectora surge la garantía de indemnidad, objeto de estudio del presente trabajo, que no es otra cosa que una ampliación de la protección originaria recogida en el art. 24.1 de la CE que reconoce el derecho de todos los ciudadanos a acceder a los Jueces y Tribunales y a obtener, de los mismos, una tutela judicial efectiva. El ámbito de actuación de la garantía de indemnidad está mucho más limitado, pues está dirigido, únicamente, a garantizar la protección de los trabajadores ante las posibles represalias que pudiera sufrir por parte del empresario.
[EN] This work is reflected through the completion of a legal opinion of Social jurisdictional order, and within this, the realization of a Case on dismissals. In the context of labor relations there are many business decisions with violations of fundamental rights, which the Spanish Constitution recognizes workers. This protective need indemnity guarantee, object of study of this work, which is nothing but an extension of the original collection of art arises protection. 24.1 of the C.E recognizing the right of all citizens to have access to the Courts and obtain thereof, effective judicial protection. The scope of the guarantee of indemnity is much more limited, it is intended solely to ensure the protection of workers against possible retaliation that might be incurred by the employer.
