SUCESIÓN TESTAMENTARIA EN EL ÁMBITO DEL REGLAMENTO 650/2012. EL REENVÍO Y LA REMISIÓN A UN ESTADO PLURILEGISLATIVO.

Abstract

[ES]En este trabajo de investigación se va analizar la sucesión testamentaria en el Reglamento (UE) nº 650/2012 del Parlamento Europeo y del Consejo, de 4 de julio de 2012, sobre sucesiones. Centrado, en un primer lugar, en los aspectos generales de la sucesión testamentaria en relación con el Reglamento, la competencia judicial internacional, la determinación de la ley aplicable a la sucesión y el reconocimiento y ejecución de las resoluciones. En un segundo lugar, este trabajo se centra en dos supuestos incluidos en la ley aplicable, uno es la remisión a un Estado plurilegislativo y el otro, es el reenvío. En un principio se va analizar la problemática que hay alrededor de la remisión a un sistema plurilegislativo con base territorial. Posteriormente, se va hacer un examen de la inclusión del reenvío en el Reglamento.

[EN]In this work of investigation it goes away the testamentary succession analyzes in the Regulation (EU) n º 650/2012 of the European Parliament and of the Advice, of July 4, 2012, on successions. Centred, in the first place, in the general aspects of the testamentary succession in relation with the Regulation, the judicial international competition, the determination of the law applicable to the succession and the recognition and execution of the resolutions.

In the second place, this work centres on two suppositions included in the applicable law, one is the reference to a State plurilegislative and other one, is the remand. In a beginning it goes away to analyze the problematics that exists about the reference to a system plurilegislative with territorial base. Later, it goes away to do an examination of the incorporation of the remand in the Regulation.
