Derechos Humanos y globalización: Explotación laboral y sexual de menores de edad.

Abstract

[ES] El fomento de los Derechos Humanos de los niños, violados por la explotación laboral y sexual es una cuestión que no atañe solamente a los Estados sino a todos como seres humanos. En este trabajo se examinan unas breves ideas de cómo este tipo de derechos humanos evolucionan desde que los niños son sujetos de derechos hasta hoy. Desde el punto de vista normativo tratamos de responder cuál es el mecanismo de protección internacional por excelencia; la Convención Sobre los Derechos del niño así como también aquellos que tratan de proteger la figura de los menores de edad. Paralelamente incluye datos estadísticos de diferentes organismos para vislumbrar el panorama actual y terminamos con un caso de la Audiencia Provincial de Jaén, cuya intencionalidad es demostrar que no hay que irse fuera de nuestro país, ni fuera de nuestra provincia para enseñar que este tipo de problemas no son independientes a nosotros.

[EN] Promote the human rights of children who have been constantly violated by labor and sexual explotaiton must be a responsability from humanity. This paper examines some brief ideas of how these types of human rights evolve since children are subject to rights until today. Normativally, it try to answer which is the international protection mechanism par excellence; The Convention on the Rights of the Child, as well as those that try to protect the figure of minors. At the same time, it includes statistical data from different organizations to see the current panorama and ended with a case of the Provincial Court of Jaén, whose intention is to demonstrate that you do not have to leave outside our country, nor outside our province to teach that this type of problem they are not independent of us.
