Contratos turísticos: contrato de aprovechamiento por turno de bienes inmuebles de uso turístico

Abstract

[ES] El presente trabajo trata sobre los derechos de aprovechamiento por turno de bienes inmuebles de uso turístico y su marco jurídico.

En el mismo se expone la evolución de la normativa que regula dichos contratos de aprovechamiento, los trámites para la constitución del régimen, el contenido de los contratos, y los requisitos legales exigidos. Esta exposición sirve de base para un posterior análisis de los factores que crean el desamparo del consumidor en este tipo de transacciones comerciales y la evolución que ha tenido la ley en España por transposición europea, para fijar amparo legal al consumidor y evitar los casos de fraude que se dieron a lo que inicialmente se denominó multipropiedad.

[EN]The herby paper deals with the real estate time-sharing rights and its legal framework. It sets forth the evolution of the regulation governing the time-sharing agreements, the procedures for the establishment of its regimen, the terms of the agreements and the applicable legal requeriments. This serves as the basis for a further analysis of the factors that generate the defenceless position of the customer in this kind of commercial transactions and the evolution of the Law in Spain, due to the transposition of the European legal framework, to provide the customer with legal protection and to avoid the cases of fraud that took place in relation to, what was initially called, ”multipropiedad”.
