Resumen
[ES] El trabajo que voy a desarrollar trata sobre la adopción, tanto nacional como
internacional, todos sus componentes legislativos, anteriores y nuevos, que la
rodean. También trataré algunos puntos relacionados con los menores que
requieren de una mención especial, como es los menores en situación de
desamparo y los menores con problemas de conducta, así como las Instituciones
encargadas de su tutela y los centros específicos en los que serían internados,
respectivamente.
La pretensión al realizar este trabajo es proceder a un análisis de fondo sobre el
proceso de adopción y lo que lo constituye, así como intentar remarcar
situaciones y figuras jurídicas en las que subyace la protección al menor.
Desarrollaré con detalle los requisitos que deben de cumplir los interesados en
adoptar y los trámites necesarios para poder hacerlo. Por último, el
procedimiento a llevar a cabo en la adopción por los interesados en adoptar y
por los organismos que tienen competencia en ello.
[EN] The topic in my work is the adoption, both national and international, all legislative components, old and new, surrounding, as well as some points related to children who require special mention. The intention of this work is to move to the sender all that entails the adoption process and we can be aware of all personal and administrative requirements to be met to make it possible. My goal is that after the end of this legislative study it is clear the main points on which the adoption is based. Something very important that you must know is that the adoption process is very long and, too often, is a process that many adoptive parents find it difficult to cope with. And the requeriments that are required to adopt a child are not available to everyone. Following the completion of this TFG is normal that certain concerns about the issue of adoption. It may surprise all the bureaucratic process necessary for the fulfillment of adoption. Página | 41 Criticism has to give adoptions is that it is available to individuals and wealthy families. Well, not everyone, even if he wants, can withstand the amount involved in this figure, since all the procedures that conform are too expensive. And usually it is a very slow process, it may take years before a decision is made effective. A breakthrough has been the development of the principle of best interest of the child, which is mandatory throughout the adoption process. It is important to counter trafficking and commodification of children first. But this principle should not stand alone in this matter, but in all matters concerning minors. Treaties, conventions and decrees come from international agencies have favored the protection of minors and made that States should not worry as such a vulnerable group as children are. The new family types such as single parents, homo, etc., have made or not relevant within that family will integrate the child, but if that family is unable or unwilling to meet their needs.
