LA PRESTACIÓN BÁSICA DEL EMPRESARIO EN LA RELACIÓN LABORAL: EL SALARIO. DESIGUALDAD Y DISCRIMINACIÓN SALARIAL.

Resumen
[ES]El presente proyecto aborda el tema del salario, de gran importancia tanto para
el contrato de trabajo, ya que es un elemento básico del mismo, como para el Derecho
del trabajo en general. De esta forma, se contribuirá a profundizar sobre su estudio,
puesto que, la determinación del salario no se ha configurado de la mima forma a lo
largo de la historia.
La justificación didáctica de este tema estriba en el hecho de alcanzar y
desarrollar la capacidad de conocer la legislación laboral y los derechos y obligaciones,
incidiendo sobre todo en el conocimiento de la obligación básica del empresario/a, en
el seno de la relación laboral.
Se pretende identificar los factores asociados a la prestación básica del
empresario/a, el salario, el lugar, el tiempo y la forma de pago del mismo. También
conocer la esencia y el sentido del salario mínimo interprofesional, así como la
protección del salario, tanto frente a los acreedores del trabajador/a, como del
empresario/a.
Asimismo, se analiza este tema para conocer el comportamiento de los ingresos
laborales entre trabajadores/as y las desigualdades salariales entre mujeres y hombres
con igual productividad e iguales funciones, simplemente por ser de distinto género.
Destacando que, la equidad de género debe ser prioritaria en la agenda económica y
productiva de un país.
Se reflexiona acerca de las diferentes causas que originan la desigualdad
salarial, presentando breves consideraciones sobre los factores que pueden influir en
el medio y largo plazo y, a modo de cierre, se planteará las conclusiones del trabajo.

[EN]This project addresses the issue of salary, of great importance for both the work contract, as it is a basic element of it, and for labor law in general. In this way, it will help to deepen their study, since, the determination of salary has not been configured in the same way throughout history. The didactic justification of this subject lies in the fact of reaching and developing the ability to know labor law and rights and obligations, focusing especially on the knowledge of the basic obligation of the employer, within the employment relationship. The aim is to identify the factors associated with the employer's basic benefit, salary, place, time and payment method. Also know the essence and meaning of the minimum wage interprofessional, as well as the protection of the salary, both in front of the creditors of the worker, as the employer. Likewise, this topic is analyzed to know the behavior of labor income among workers and wage inequalities between women and men with equal productivity and equal functions, simply because they are of different gender. Emphasizing that, gender equity must be a priority in the economic and productive agenda of a country. It reflects on the different causes that give rise to wage inequality, presenting brief considerations on the factors that may influence the medium and long term and, as a closing, the conclusions of the work will be presented.
