LAS RELACIONES PATERNO FILIALES EN SITUACIONES DE CRISIS. LA CUSTODIA COMPARTIDA

Abstract

[ES] En el siguiente trabajo abordaremos el sistema de custodia compartida, este sistema se reconoció por primera vez con la Ley 15/2005, de 8 de Julio, por la cual se modificó el Código Civil y la Ley de Enjuiciamiento Civil, en materia de separación y divorcio. Es cierto, que dicho sistema había sido llevado a la práctica por nuestros Tribunales desde hace años, pero no fue hasta la incorporación de la ley cuando se incorporó de forma legal. Comenzaremos estudiando las crisis matrimoniales y sus efectos sobre los hijos, más tarde analizaremos la custodia compartida, primero de forma más general, viendo su origen, inclusión y modalidades, después los aspectos más complejos de dicho sistema.
