HOMICIDIO IMPRUDENTE Y SEGURIDAD VIAL.

Abstract

[ES] El presente dictamen jurídico, se ha centrado en conseguir y justificar un trato penológico más benévolo del que consideramos que es merecedor D. Pedro Luque, acusado de una acción imprudente del cual se derivan dos tipos penales: -Homicidio imprudente (142 CP) -Delito contra la seguridad vial (379.2 CP). A lo largo del estudio de esta acción imprudente encontramos derivadas otras circunstancias modificativas de la responsabilidad criminal, las cuales deberá de dirimir el tribunal a quo, y si son estimadas o no y cuál es el por qué. Desde nuestro punto de vista debe de ser merecedor de un trato favorable y es que desde la perspectiva que la práctica nos confiere, son pocas las personas que tienen una labor tan colaborativa y favorecedora de la investigación. Además de su arrepentimiento profundo y espontáneo, tal y como es constatado en el atestado policial, así como otros innumerables factores ya esgrimidos e incluidos en este dictamen jurídico.

[EN] This legal opinion has focused on reaching and justifying a more lenient penological treatment, which we consider deserves Mr. Pedro Luque, defendant in a case of reckless action from which two criminal types result: Involuntary manslaughter (article 142 Criminal Code) -Crime against road safety (article 379.2 Criminal Code) Throughout the study of this reckless action, we can see there are other circumstances modifying the criminal responsibility of the defendant. These will have to settled by the tribunal a quo, which are upheld or not, and the reasons for it. From our point of view, the defendant deserves favourable treatment. This is so as, from the perspective that professional practice provides us with, very few people collaborate and support so much the investigation. Together with that, his deep and spontaneous remorse must be noted, as it is stated in the police report, together with other numerous factors already laid and included in the present legal opinion.
