EL DERECHO A LA LIBERTAD RELIGIOSA A LA LUZ DEL CONSTITUCIONALISMO ESPAÑOL

Abstract

[ES]Durante este trabajo, se realizará un análisis minucioso sobre la libertad religiosa y las relaciones entre la Iglesia y el Estado a lo largo de todo el constitucionalismo español, por razón del mayor peso social que la Iglesia Católica ha tenido en la historia de nuestro país respecto al resto de confesiones. Dicho análisis se llevará a cabo por medio del método histórico jurídico y comentando los artículos y leyes con referencia religiosa. Ha sido un largo camino desde la confesionalidad intolerante de la Constitución de Cádiz hasta el afianzamiento del principio de libertad religiosa en nuestra Constitución actual, pasando por la confesionalidad sin matices reflejada en las Constituciones de 1837 y 1845 u otra confesionalidad más tolerante, como la que recogían la Constitución de 1869 y 1876. Finalmente, estudiaremos la Constitución 1931 y el tratamiento que se le dio a este derecho durante el Régimen franquista.

[EN]In the course of this work, it has pretended to make a meticulous research about religious freedom and the connections between Church-State along all Spanish contitucionalism as consequence of the influential role of the catholics have had in our history comparatively with other confessions. Such research it will carry out by the historical-juridical methode and with comentaries about articles and laws with religious references. It has been a long way since the intolerant confessionalism of the Cadiz Constitution until the consolidation of liberty freedom in our present Constitution, going through confessionalism without nuances reflected in the constitutions of 1837 and 1845 or other confessionalism more tolerant, as the constitutions of 1869 and 1876.Furthermore, it will be studied the Constitution of 1931 and the treatment of this right during the Franco system.
