Resumen
La importante reforma de la Ley de Enjuiciamiento Criminal efectuada en 2002,
por la Ley Orgánica 38/2002 de 24 de Octubre de reforma parcial de la Ley de
Enjuiciamiento Criminal para el enjuiciamiento rápido e inmediato de determinados
delitos y faltas, supuso una agilización del proceso penal. El motivo principal que llevó
a esta modificación fue la necesidad de mayor celeridad en los juicios rápidos e
inmediatos en España debido al colapso de causas pendientes en los Juzgados de
Instrucción de lo Penal.
A raíz de la reforma se instaura una regulación propia para este tipo de
procedimiento especial y, por consiguiente, un ámbito propio de aplicación que supone
una limitación a la hora de enjuiciar mediante este proceso. Sólo los delitos establecidos
en la Ley de Enjuiciamiento Criminal podrán ser enjuiciados a través de este
procedimiento.
The important reform of the Law of Criminal Prosecution effected in 2002, for the Organic Law 38/2002 of October 24,of partial reform of the Law of Criminal Prosecution for the rapid and immediate prosecution of certain crimes and lacks, supposed an acceleration of the penal process. The principal motive that led to this modification was the need of major speed in the rapid and immediate judgments in Spain due to the collapse of hanging reasons in the Examining magistrate's courts of the Penal thing. Immediately after the reform an own regulation is restored for this type of special and, procedure consequently, an own area of application that supposes a limitation at the moment of judging by means of this process. Only the crimes established in the Law of Criminal Prosecution will be able to be judged across this procedure.
