EL CONTRATO DE COMPRAVENTA

Abstract

[ES] El objetivo principal será estudiar el Título IV, de su Libro IV del Código Civil, especialmente en el contrato de compraventa y sus principales características. Estudiaremos sus conceptos y características claves, se diferenciará entre el contrato de compraventa civil y el mercantil, también los elementos de la compraventa (reales, personales y formales). Veremos también las obligaciones de las partes tanto el comprador como el vendedor, con respecto a las maneras que establece el Código Civil, así como sus condiciones. Se hará referencia también al supuesto de Saneamiento en los diferentes tipos y casos que existen, veremos también los riesgos de la compraventa, la doble venta, las compraventas especiales, compraventas a prueba y ad gustum, pacto in diem addictio, compraventa de bienes muebles a plazos y el contrato de permuta. Y para finalizar, escribiré unas conclusiones finales sobre el trabajo, además de aportar toda la legislación, jurisprudencia, bibliografía y demás cosas utilizadas en la realización del trabajo.

[EN] The main objective will be to study the Civil Code’s Title IV, especially in sales contract and its main modalities. We will study their concepts and key features. Also, we will find the differences between civil and commercial sales contract and between the different trading elements (real, personal and formal). Moreover, we can see the buyers’ obligations, and the sellers’ obligations, with regard to the way Civil Code set and its conditions. It will be referenced the different types and cases of the Sanitation and the risks of the trading, the double sale, the special trading, trading on trial and “ad gustum, pacto in diem addictio”, the personal property trading and the swap contract. Furthermore. Finally, I’ll write the final conclusion about the project and I will provide the law, the jurisprudence, bibliography and more things used in this project.
