For the analysis of telecommuting, two generic regulations are being applied. On the one hand, there is the Royal Decree Law 28/2020 of the 22nd of September, of working remotely. On the other hand, in the preventive area, the Law of 31/1995, the 8th of November, of Occupational Risk Prevention. There will be studied the rights and obligations that have the entrepreneur as much as the teleworker in the preventive area, the possible risks that could be originated from telecommuting, for instance, the right to digital disconnection that lies in guaranteeing outside the legal work time or commonly laid down, respect breaks, permissions and holidays, just like the employee’s personal and familiar privacy.
