La desobediencia civil: Análisis de la teoría de la desobediencia civil en la obra de Ronald Dworkin

Abstract

[ES]La finalidad de este trabajo es analizar la desobediecia civil. He realizado un detallado análisis de la desobediencia en nuestro sistema democrático, y he examinado este concepto en la obra de Ronald Dworkin . He escrito una intoducción histórica para mostrar cómo la desobediencia civil fue muy importante en la vida de millones de personas. Para entender la desobediencia civil es necesario distinguirla de otras figuras como la objeción de conciencia y la desobediencia violenta. En este trabajo he diferenciado los puntos de vista de Ronald Dworkin de la doctrina del positivismo jurídico. En mi opinión, mostrar las similutudes y diferencias de ambas formas de pensamiento es algo interesante para la comprensión del ordenamiento jurídico.

Finalmente, he exminado el impactoo de la desobediencia civil en nuestros días.

[EN]The purpose of this dissertation is to analyze the civil disobedience. 1 perform a detailed analysis of disobedience in our democratic system, and 1 have examined th is concept in the work of Ronald Dworkin. 1 have written a historical introduction to show how the civil disobediencc was very importan !in the lives of millions of people. To understand civil disobedience is necessary to distinguish it from other figures like conscientious objection and violent disobedience. In this dissertation 1 have also analyzed every significan! element of the work of Ronald Dworkin, like the importance of judges, civil obligations and the possible action of citizens who are annoyed with a measure or law. For other hand 1 have differentiated the Ronald Dworkin's reviews from the doctrine of legal positivism. In my opinion, showing the similarities and differences of both fonns of thinking is something interesting for the understanding of the legal system

Finally, I review the impact of legal civil desobedience in our days.
