El Terrorismo de Estado de la Democracia: La Responsabilidad Penal de Felipe González en los Delitos Cometidos por los Grupos Antiterroristas de Liberación.

Abstract

En este trabajo se abordarán los delitos cometidos por los Grupos Antiterroristas de Liberación, en particular, la especial responsabilidad de Felipe González en tales delitos. Esta responsabilidad se analizará no sin antes evaluar la doctrina teórica acerca de los delitos omisivos, la cual facilitará el análisis y la comprensión del caso, además de la institución de “garante” omitida por la pasividad del Estado y del Presidente del Gobierno, en particular. La cuestión que se pretende discernir es la de averiguar si efectivamente se produjo por autoridades del Estado un comportamiento ilícito constitutivo de delito. Para ello, se analizarán los GAL, en su conjunto, desde una perspectiva histórica, política y jurídica, evaluando las controversias planteadas por la doctrina y la jurisprudencia española. En último lugar, se realiza un análisis jurídico comprobando los motivos que han llevado a los tribunales a negar la inculpación y responsabilidad del ex-Presidente del Gobierno, Felipe González.

This document will address the crimes committed by the Anti-Terrorist Liberation Groups (GAL), in particular, the special responsibility of Felipe González in such crimes. This responsibility will be analyzed not without first evaluating the theoretical doctrine about omission crimes, which will facilitate the analysis and understanding of the case, in addition to the institution of "guarantor" omitted by the passivity of the State and the Prime Minister, in particular. The question to be discerned is to find out whether an illicit behavior constituting a crime was actually produced by State authorities. For this, those GAL will be analyzed, as a whole, from a historical, political and legal perspective, evaluating the controversies raised by Spanish doctrine and jurisprudence. Lastly, a legal analysis is carried out, checking the reasons that have led the courts to deny the blame and responsibility of the Prime Minister, Felipe González.
