DERECHO AL NOMBRE DE LA PERSONA FÍSICA: PERSPECTIVA DE DERECHO INTERNACIONAL PRIVADO ESPAÑOL.

Abstract

[ES]El objetivo del presente trabajo es el estudio del derecho al nombre de la persona física en el Derecho internacional privado español y en concreto su regulación en distintas normas de origen convencional y autónomo. Esta reglamentación otorga respuesta a temas, principalmente a: la determinación del nombre, los cambios de apellidos y las cuestiones relativas con la identificación de la persona en relación al nombre. Del mismo modo se da cuenta de los problemas relacionados con la aplicación del Derecho extranjero y se analiza jurisprudencia del TJUE sobre el tema objeto de estudio.

[EN]The objective of the present work is the study of the law to the name of the natural person in the Spanish private international law and in particular its regulation in different norms of conventional and autonomous origin. This regulation answers questions related to: the determination of the name, the changes of surnames and the questions related to the identification of the person in relation to the name. It also gives an account of the problems related to the application of foreign law and analyzes the case law of the CJEU on the subject under study
