Entrada en prisión. Análisis de los factores que condicionan la reinserción social

Abstract

El presente trabajo tiene como objetivo estudiar el origen de la conducta delictiva y los esfuerzos de las autoridades por atacar el problema. El estudio comienza con en la construcción social del delincuente vinculado con las situaciones de pobreza y exclusión, para luego hablar de reclusos y exreclusos, refiriéndonos a los delincuentes que pasan por la cárcel. El trabajo no pretende dar a conocer el entorno carcelario como la institución de gobierno cuya función es el cumplimiento de la ley, ni los objetivos ideales que se establecen en Ley Orgánica General Penitenciaria, sino indagar en la realidad social de la prisión, las prácticas que se llevan a cabo, el funcionamiento, la organización y las características de la institución. De igual modo, no trata de recorrer el Reglamento Penitenciario para conocer los derechos, deberes o servicios que deben prestarse a los reclusos, sino de conocer las condiciones de vida, grado de cumplimiento de los objetivos y las consecuencias que la prisión genera en la vida de las personas que entran en ella. El fin último de este trabajo es reunir argumentos que lleven a la conclusión de que tal y como se establece el sistema penal, la idea de reinserción social es inconcebible, lo que se traduce finalmente en el aumento de la vulnerabilidad social que ya padecían antes de entrar en prisión, por el estigma y el rechazo que los presos encuentran en la sociedad tras cumplir su condena. Por último, señalamos la importancia del Trabajo Social en este ámbito para conseguir la integración social del que ha sido privado de libertad

The main objective of this project is to study the origin of criminal behavior and the efforts of the authorities to facing the problem. The study begins with the social construction of the criminal linked to situations of poverty and exclusion, and then talks about inmates and ex-inmates, referring to criminals who spend time in prison. The work does not intend to make the prison environment known as the government institution whose function is to comply with the law, nor the ideal objectives established in the General Penitentiary Organic Law, but to investigate the social reality of the prison, the practices that are carried out, the functioning, the organization and the characteristics of the institution. In the same way, it does not try to go through the Penitentiary Regulations to know the rights, duties or services that must be provided to inmates, but to know the living conditions, the degree of fulfillment of the objectives and the consequences that the prison generates in life. of the people who enter it. The ultimate goal of this work is to gather arguments that lead to the conclusion that, as the penal system is established, the idea of social reintegration is inconceivable, which ultimately translates into an increase in the social vulnerability that they already suffered before. entering prison, due to the stigma and rejection that prisoners find in society after serving their sentence. Finally, we point out the importance of Social Work in this area to achieve the social integration of those who have been deprived of liberty
