Resumen
La pena de trabajos en beneficio de la comunidad, como pena
privativa de derechos, se caracteriza principalmente por exigir el
consentimiento expreso y previo del penado. El objeto principal de este
trabajo es analizar su pena, que fue introducida por el CP de 1995 como
una manifestación del principio de reinserción, además de su evolución y
funciones en nuestro ordenamiento jurídico, así como su aplicación
como pena principal, pena sustitutiva de la prisión o como modalidad de
la responsabilidad subsidiaria por impago de multa y, sobre todo, las
consecuencias que desencadenaría su incumplimiento.
The penalty of community service, as a disqualification penalty, is mainly characterized by requiring the express and prior consent of the convicted person. The main purpose of this paper is to analyze its penalty, which was introduced by the 1995 PC as a manifestation of the principle of reintegration, in addition to its evolution and functions in our legal system, as well as its application as a main penalty, a substitute penalty for imprisonment or as a form of subsidiary liability for non- payment of fines and, above all, the consequences of non-compliance.
