PLAN DE AUTOPROTECCIÓN EN UN COMPLEJO HOTELERO

Abstract

[ES] Dentro del sector turístico, una de las principales fuentes de ingreso son los complejos hoteleros. La organización interna de los mismos, debe velar por la prevención y la protección ante accidentes tales como un incendio o una asistencia sanitaria. El Real Decreto 393/2007, de 23 de marzo, modificado por el Real Decreto 1468/2008, de 5 de septiembre, por el cual se aprueba la Norma Básica de Autoprotección de los centros, establecimientos y dependencias dedicados a actividades que puedan dar origen a situaciones de emergencia, será la base para el Plan de Autoprotección presente. Dicho Plan, se fundamenta en distinta legislación, siendo de especial relevancia el artículo 20 “Medidas de Emergencia” de la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales. En él, se indica que “el empresario, siempre considerando el tamaño, la actividad de la empresa y la presencia de personas ajenas a la misma, deberá analizar las posibles situaciones de emergencia y adoptar las medidas necesarias tanto de primeros auxilios, de incendios y de evacuación. Además, deberá designarse personal encargado de aplicar dichas medidas y de su comprobación periódica. A su vez, el personal deberá tener la formación necesaria en función de las circunstancias”. El siguiente Plan de Autoprotección se requiere ya que, siguiendo el Real Decreto 393/2007, de 23 de marzo, la principal actividad del hotel objeto de estudio es la que se indica en el Anexo I del mismo, es una actividad que dispone de una ocupación igual o superior a 2000 personas.

[EN] Within the tourism sector, one of the main sources of income is the hotel complexes. The internal organisation of these must ensure the prevention and protection of accidents such as a fire or health care. Royal Decree 393/2007 of 23 March, as amended by Royal Decree 1468/2008 of 5 September 2008, which approves the Basic Standard for Self-Protection of Centres, Establishments and Units Dedicated to Activities that May Give Rise to Emergency 2 Situations, shall be the basis for the present Self-Protection Plan. This Plan is based on different legislation, and article 20 "Emergency Measures" of Law 31/1995 of 8 November on the Prevention of Occupational Risks is of particular relevance. It states that "the employer, always taking into account the size, the activity of the undertaking and the presence of outsiders, shall analyse possible emergency situations and take the necessary first aid, fire and evacuation measures. In addition, staff must be appointed to implement these measures and to carry out regular checks. In turn, staff should have the necessary training according to the circumstances". The following Self-protection Plan is required since, according to Royal Decree 393/2007, of 23 March, the main activity of the hotel under study is that indicated in Annex I of the same, is an activity that has an occupation equal to or greater than 2000 people.
