DICTAMEN JURÍDICO PENAL

Abstract

[ES] Dictamen jurídico, dentro del orden jurídico penal, que emite la letrada del ilustre colegio de abogados de Jaén, doña Rosa María Aparicio Pozo, a instancia de don Pablo Martínez Martínez, sobre la posible estafa cometida por el constructor promotor de la vivienda y local comercial que ha recibido en herencia, y que en la actualidad se encuentran gravados con sendas hipotecas de distintos bancos e incluso en procedimientos judiciales de ejecución hipotecaria. Acciones a seguir y viabilidad de las mismas, incluyendo el estudio del contrato realizado por la causante: cesión de suelo por vuelo, y el posible delito de estafa que dimana de las actuaciones objeto de estudio.

[EN] Legal opinion within the criminal legal system which is issued by the consellor of illustrious bar association of Jaén, Mrs. Rosa María Aparicio Pozo, by motion of the party Mr. Pablo Martínez Martínez , on the possible fraud commited by the developer builder of dwelling and local sales representative who has received the inherintance and which currently are taxed with great mortgages of different banks and even in judicial mortgage procedures. Actions to follow and viability of those issues, including the study of contract made by the originator: cession of land and the possible crime of fraud which arises from the intervention object of study.
