La doble maternidad

Abstract

Debido a los cambios que sufre nuestra sociedad el derecho encuentra en ellos la razón por la que debe modificar su contenido de manera constante. A continuación, y a lo largo de este trabajo vamos a analizar la posibilidad que da la ley de que exista una doble maternidad legal sin padre. Y es que dicha posibilidad aunque esté elaborada con la mejor intención posible por parte del legislador ocasiona a su vez numerosos problemas tanto por la forma en la que está redactada como por los intereses que interfieren en dicha esfera. La verdadera dificultad de este tema radica en la manifestación o no de la voluntad de filiación por parte de la madre no gestante sobre el menor. Hecho que dar lugar a numerosos pronunciamientos por parte del Tribunal Supremo donde cada vez más se entiende la filiación y la maternidad de otra manera diferente a la clásica.
