El Código civil dedica los artículos 142 a 153, ambos inclusive, a configurar la obligación legal de prestar alimentos, una institución independiente de las prestaciones alimenticias derivadas del matrimonio y de la filiación, la cual tiene lugar en el momento que alguno de los sujetos reconocidos por la ley se encuentra en un estado de necesidad que implica no poder cubrir su sustento básico por sí mismo. El Trabajo de Fin de grado que se presenta tiene como finalidad el estudio de la obligación legal de alimentos como prestación de asistencia y socorro, pues en la actualidad, cada vez son más frecuentes este tipo de reclamaciones.
