LA LIBERTAD SINDICAL Y EL SINDICATO COMO ORGANIZACIÓN SOCIAL

Abstract

[ES]El estudio del derecho fundamental de libertad sindical, es de suma importancia para cualquier trabajador/a, y por ello, para todo el alumnado de los ciclos formativos, cuyo principal objetivo es la inserción en el mercado laboral. Dicha importancia, tiene su origen en el propio contenido del derecho, pues es a través de su ejercicio, que los trabajadores/as pueden velar por sus derechos económicos y sociales frente al Estado y frente a la empresa. Para comprender el alcance y significación del derecho de libertad sindical tal y como está establecido en el ordenamiento jurídico actual, es imprescindible conocer su origen, es decir, cómo y por qué se ha ido forjando hasta convertirse en un derecho fundamental, que goza de la máxima protección jurídica, tanto a nivel constitucional como a nivel penal. Por último, para materializar el derecho de libertad sindical, hay que acudir al sindicato, como órgano de defensa de los derechos laborales, conociendo el régimen jurídico que la afiliación al mismo supone.

[EN]The study of the fundamental right of freedom of association is of utmost importance for any worker, and therefore, for all the students of the training cycles, whose main objective is the insertion in the labor market. This importance has its origin in the content of the right, because it is through its exercise, that workers can ensure their economic and social rights against the State and against the company. To understand the scope and significance of the right to freedom of association as established in the current legal system, it is essential to know its origin, that is, how and why it has been forged until it becomes a fundamental right, enjoying the maximum legal protection, both at the constitutional level and at the criminal level. Finally, to materialize the right to freedom of association, we must go to the union, as a body to defend labor rights, knowing the legal regime that membership imply.
