Protección jurisdiccional del derecho al honor, a la intimidad personal y a la propia imagen.

Abstract

Este trabajo se adentra en el artículo 18 de la Constitución Española, sobre todo en su apartado número 1 que declara el derecho al honor, a la intimidad personal y familiar y a la propia imagen, derechos que son considerados fundamentales y por ello se les asignan unos mecanismos de protección reforzados. De esta forma, se realiza un análisis de cada uno de estos derechos observando su concepto, la protección ordinaria y penal y la protección especial ante el Tribunal Constitucional mediante la figura del recurso de amparo. Finalmente, se hace un repaso sobre jurisprudencia relevante acerca del tema que nos adentra en la interpretación que pueden tener estos derechos. This work enters in the 18th article of the Spanish Constitution, specially on its first headland wich declares the right to honor, personal and familiar intimacy and the propper image, rights that are considered essential, so important that have assigned some reinforced protection mechanisms. In this way, an analysis of each one of this rights watching its concept, the ordinary and penal protection, and the special protection against the Constitutional Court by means of the figure of the help resource. Finally, a distribution on jurisprudence is done about the theme that makes us enter on the interpretation that could have this rights.
