Resumen
[ES] La pensión compensatoria es una institución que tiene sus orígenes en los primeros años de la década de 1980 y que está pensada como un método para prestar auxilio al cónyuge que necesite de ella tras la ruptura de la pareja con motivo de su escasez de recursos económicos, lo cual podría complicar sus expectativas vitales en los ámbitos personal y laboral.
Está contenida en el artículo 97 del Código Civil, y fue reformada en el año 2005 a través de la ley 15/2005, de 8 de Julio, que básicamente ha incorporado el concepto compensatorio, pues hasta dicha reforma, éste concepto estaba considerado como difuso, desequilibrado y en ocasiones injusto o arbitrario, algo ampliamente discutido entre la doctrina y el ámbito jurisprudencial.
Así pues lo que va a hacer la pensión compensatoria es reequilibrar la situación económica del cónyuge perjudicado.
[EN] Compensatory pension is an institution that has its origins in the early years of the 1980s and is intended as a method to provide assistance to the spouse who needs it after the breakup of the couple due to their scarcity of financial resources, which could complicate their vital expectations in personal and work fields. It is contained in article 97 of the Civil Code, and was reformed in 2005 through the law 15/2005, of July 8, which basically has incorporated the compensatory concept, because until such reform, this concept was considered as diffuse, unbalanced and sometimes unfair or arbitrary, something widely discussed by the doctrine and the scope jurisprudential.
