LA GESTACIÓN POR SUSTITUCIÓN. ESTUDIO SOCIAL-NORMATIVO EN EL ÁMBITO INTERNACIONAL DEL DERECHO

Abstract

[ES] A lo largo de la exposición de este proyecto, realizaremos un estudio sistemático, sobre el ámbito, modo y forma de aplicación y evolución de la maternidad subrogada, como Técnica de Reproducción Asistida (TRA) muy demandada en los últimos treinta años por personas que les es imposible concebir de manera natural y desean tener hijos sanguíneos. Así pues, y centrándonos más concretamente en el ámbito jurídico, manifestaremos la problemática que la misma plantea según el país en el que nos situemos, y, tras el análisis de su prohibición u admisión y las consecuencias moral-sociales que de ella se derivan, aportaremos para sí una serie de referencias o soluciones posiblemente aplicables tanto de forma nacional como a nivel internacional, siguiendo la doctrina del Tribunal Supremo y del Tribunal Europeo de Derechos Humanos.

[EN] In this project, we will study the scope, way and form of application and evolution of surrogate motherhood, such as Assisted Reproduction Technique (ART), which has been much sought after in the last thirty years by people who are unable to have children naturally. Thus, in the legal field, we will discuss the problems posed by the country in which we are located, its prohibition or admission and the moral and social consequences that derive from it, we will provide solutions applicable nationally and internationally , following the jurisprudence of the Supreme Court and the European Court of Human Rights.
