En el trabajo he ahondado sobre las facetas que son determinantes respecto a los elementos que constituyen una adecuada defensa jurisdiccional frente a la publicidad ilícita en el momento actual tras la modificación de la Ley 29/ 2009 de 30 de diciembre que unifica las acciones de la LCD y LGPU.
La investigación que he realizado me ha llevado a profundizar respecto a cuáles son las acciones, quién tiene la legitimidad, quién tiene que aportar la carga de prueba, plazos, competencia, los tipos de publicidad existentes que son considerados ilícitos y las nuevas conductas que consideramos como publicidad ilícita; además de otras nuevas vías a las que se tiene que enfrentar la publicidad como es la defensa de la mujer frente a estas conductas desleales.
[EN] In the work I have delved into the facets that are decisive with respect to the elements that constitute an adequate judicial defense against the illicit publicity at the present moment after the modification of the Law 29/2009 of December 30 that unifies the actions of the LCD and LGPU. The research I have done has led me to delve deeper into what actions, who has the legitimacy, who has to contribute the burden of proof, deadlines, competition, the types of advertising that are considered illegal and the new behaviors we consider as illicit advertising; in addition to other new ways that have to face advertising as it is the defense of women against these unfair behavior.
