ADOPCIÓN INTERNACIONAL. RECONOCIMIENTO EN ESPAÑA DE ADOPCIONES QUE SE LLEVAN A CABO EN EL EXTRANJERO.

Abstract

En el presente trabajo vamos a estudiar la materia sobre adopción internacional en España, prestaremos mayor atención al reconocimiento de adopciones extranjeras realizadas por autoridades extranjeras. Para ello, haremos un estudio sobre toda la legislación relacionada con esta figura jurídica. A lo largo de todo el cuerpo del trabajo desarrollaremos cuestiones como son los requisitos, procedimiento, competencia, ley aplicable, así como reconocimiento de adopciones internacionales en España. Podremos ver que existe distinta normativa a nivel internacional, nacional y autonómico, y que la legislación ha sufrido diferentes modificaciones a lo largo de la historia. En el estudio del reconocimiento de adopciones extranjeras constituidas en el extranjero, veremos que dependiendo de si la adopción ha sido constituida de acuerdo al Convenio de la Haya de 1993 o no, tendrá características diferentes.

In this paper we will study the matter of international adoption in Spain, we will pay more attention to the recognition of foreign adoptions made by foreign authorities. To do this, we will study all the legislation related to this legal figure. Throughout the body of work we will develop issues such as requirements, procedure, competence, applicable law, as well as recognition of international adoptions in Spain. We can see that there are different regulations at international, national and regional level, and that the legislation has undergone different modifications throughout history. In the study of the recognition of foreign adoptions registered abroad, we will see that depending on whether the adoption has been constituted in accordance with the 1993 Hague Convention or not, it will have different characteristics.
