Resumen
[ES] Este trabajo trata de la gestación por sustitución o, conocida de
otro modo, maternidad subrogada pero no en un ámbito general
sino que he entrado a valorar sus aspectos comunes y
diferenciadores entre España y otros países, tanto europeos como
no europeos y, en definitiva, he tratado de ofrecer un estudio de la
situación actual de la gestación por sustitución.
La finalidad de este trabajo ha sido la de llevar a cabo la labor de
dar a conocer esta técnica perteneciente al grupo de técnicas de
reproducción humana asistida entrando a valorar su problemática
contractual, su validez jurídica dependiendo del lugar en el que se
realice el contrato, las partes intervinientes en el contrato y el
grave problema de inscripción registral del nacido mediante el uso
de esta técnica, puesto que ello presenta un gran dilema debido a
la posibilidad de que el nacido quede desamparado.
[EN] This paper discusses the gestation by substitution or, in other words, surrogacy but not in a general area but I have come to appreciate their common and differentiating aspects between Spain and other countries, both European and non-European. In short, I have tried to provide a study of the current situation of the pregnancy substitution. The purpose of this work was the carry out the work to make this technique belongs to the Group of human reproduction techniques assisted to assess their contractual problems, its legal validity depending on the place that will perform the contract, the parts involved in the contract and the serious problem of registration of the born through the use of this technique, since it presents a great dilemma because of the possibility that the child is helpless
