LA INTERVENCIÓN DEL MENORES EN EL PROCESO DE LA MEDIACIÓN

Abstract

El presente trabajo trata sobre la mediación familiar, centrándose en situaciones de separación, divorcio, mediación escolar y mediación intergeneracional en las que se encuentran implicados los menores. Con este trabajo lo que se pretende es obtener conocimiento de cómo interviene el menor ante estos procesos. Como veremos a continuación, una forma de tener en cuenta las necesidades de los hijos durante todo este proceso es a través de la mediación, en la que existen diferentes procedimientos de inclusión de los menores, aunque el hecho de que participen o no en ésta es un tema muy controvertido y suscita mucha polémica entre los propios mediadores a pesar de que hay que incluirlos ya que son los más vulnerables en el contexto familiar.

This paper deals with the family mediation, but focusing on situations of separation, divorce, school mediation and intergenerational mediation where children are involved. With this work it is intended to obtain knowledge about how the children take part in front of this process. One way to take into account the needs of children throughout this process is through mediation where there are different procedures for inclusion of minors, but the fact that they participate or not in this, it is a very controversial issue and provokes a great controversy among the mediators themselves, although they must be included since they are the most vulnerable in the family context.
