LA ESTRUCTURA POLÍTICO Y SOCIAL DE LA REPÚBLICA ROMANA

Abstract

[ES] El objetivo del presente estudio consiste en el análisis de las diversas instituciones políticas y jurídicas de la república romana, así como su trascendencia e influencia sobre el constitucionalismo moderno. La república romana constituye uno de los más complejos y efectivos sistemas de organización política y social de la antigüedad, y cuyo legado más importante es la presencia de elementos con precedentes romanos que configuran nuestro marco jurídico-político de nuestra democracia moderna. Por tanto, durante el transcurso de este estudio se determinarán las causas tanto de origen como de declive de la república, así como las garantías existentes para los individuos y los problemas a los que debía enfrentarse este sistema, el cual no es ajeno a la naturaleza corruptible del ser humano.

[EN] The objective of the present study consists in the analysis of the diverse political and legal institutions of The Roman Republic, as well as their transcendence and influence on the modern constitutionalism. The Roman Republic is one of the most complex and effective systems of political and social organization of antiquity, and whose most important legacy is the presence of elements with Roman precedents that shape our legal-political framework of our modern democracy. Therefore, during the course of this study we will determine the causes of both origin and decline of the republic, as well as the existing guarantees for individuals and the problems that had to face this system, which is not alien to corruptible nature of humans.
